{"id":67,"date":"2015-09-28T20:40:43","date_gmt":"2015-09-29T00:40:43","guid":{"rendered":"https:\/\/ipmanagement.harnessip.com\/?p=67"},"modified":"2015-10-03T21:54:30","modified_gmt":"2015-10-04T01:54:30","slug":"state-statute-restricting-assertion-of-patent-infringement-not-at-issue-so-remand-to-state-court-appropriate","status":"publish","type":"post","link":"https:\/\/ipmanagement.harnessip.com\/?p=67","title":{"rendered":"State Statute Restricting Assertion of Patent Infringement Not At Issue, So Remand to State Court Appropriate"},"content":{"rendered":"<p>Many of the states have passed legislation purporting to restrict a patent owner&#8217;s right to make accusations of infringement. \u00a0Some of these statutes seem to be of questionable validity, but we will have to wait for a determination. \u00a0In <em>State of Vermont v, MPHJ Technology Investments, LLC<\/em>, [2015-1310] (September 28, 2015), the Federal Circuit affirmed the district court&#8217;s remand back to state Court, finding that the Vermont Bad Faith\u00a0Assertions of Patent Infringement Act (\u201cBFAPIA\u201d) had not (yet) been raised by the state.<\/p>\n<p>The State of Vermont initiated an\u00a0action\u00a0under the Vermont Consumer Protection Act, 9 V.S.A.\u00a0\u00a7 2453(a) for unfair trade practices and deceptive\u00a0trade practices arising from MPHJ&#8217;s conduct in sending patent infringement warnings in the State of Vermont. \u00a0The district court found that Vermont was not\u00a0seeking an injunction that requires MPHJ\u2019s compliance\u00a0with the Vermont Bad Faith\u00a0Assertions of Patent Infringement Act (\u201cBFAPIA\u201d), 9\u00a0V.S.A. \u00a7\u00a7 4195\u201399..
