{"id":399,"date":"2019-01-25T18:43:07","date_gmt":"2019-01-25T23:43:07","guid":{"rendered":"https:\/\/ipmanagement.harnessip.com\/?p=399"},"modified":"2019-01-26T16:12:31","modified_gmt":"2019-01-26T21:12:31","slug":"everything-old-is-new-again","status":"publish","type":"post","link":"https:\/\/ipmanagement.harnessip.com\/?p=399","title":{"rendered":"Everything Old is New Again"},"content":{"rendered":"\n<p>Photographer Douglas Kirkland has sued the Kfir Moyal Art Gallery Inc., in the Southern District of Florida (1:19-cv-20293-DPG), alleging that the Gallery copied and distributed Kirkland\u2019 copyrighted Work for purposes of advertising and promoting Kfir Moyal\u2019s business, and in the course and scope of advertising and selling products and services.<\/p>\n\n\n\n<p>The courts have been accommodative of artists who use preexisting images in their work, as long as the use is &#8220;transformative.&#8221;    The question is whether Kfir Moyal&#8217;s image on the left is in fact transformative of Kirkland&#8217;s 1965 photo of  Brigitte Bardot on the right.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"510\" src=\"https:\/\/ipmanagement.harnessip.com\/wp-content\/uploads\/2019\/01\/Kirkland_v_Moyal-1024x510.jpg\" alt=\"\" class=\"wp-image-400\" srcset=\"https:\/\/ipmanagement.harnessip.com\/wp-content\/uploads\/2019\/01\/Kirkland_v_Moyal-1024x510.jpg 1024w, https:\/\/ipmanagement.harnessip.com\/wp-content\/uploads\/2019\/01\/Kirkland_v_Moyal-300x149.jpg 300w, https:\/\/ipmanagement.harnessip.com\/wp-content\/uploads\/2019\/01\/Kirkland_v_Moyal-768x382.jpg 768w, https:\/\/ipmanagement.harnessip.com\/wp-content\/uploads\/2019\/01\/Kirkland_v_Moyal-500x249.jpg 500w, https:\/\/ipmanagement.harnessip.com\/wp-content\/uploads\/2019\/01\/Kirkland_v_Moyal.jpg 1203w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><figcaption>Is the image on the left transformative of Kirkland&#8217;v 1965 photo of Brigitte Bardot?<\/figcaption><\/figure>\n\n\n\n<p>Kirkland&#8217;s lawyers are cleverly focus the Complaint not on the artistry of the Kfir Moyal&#8217;s image, but on its commercial use in advertising and promotion, hoping to avoid favorable treatment many courts give purely artistic works.
