<\/a>so that a mural of\u00a0Charles Bukowski, a noted poet and tragic alcoholic, could be painted,\u00a0apparently\u00a0to promote a bar to be known as \u201cBukowski\u2019s:<\/p>\nThe case, Thrasher v. Siegel<\/a>, 2:17-cv-03047\u00a0is pending in the Central District of California.<\/p>\n There are some other notable applications of Visual Artists Rights Act (VARA), of which the property owners need to be aware. \u00a0Permitting artwork to be placed on property without the proper planning, can interfere with subsequent alterations to the building.<\/p>\n In Henderson v. Ziman<\/a>, (2:14-cv-03042-SJO-AS) (C.D. California), artist Victor Henderson sued\u00a0for damages for the destruction of the\u00a0mural “Brooks Avenue Painting” that he helped\u00a0paint in 1969:<\/p>\n His complaints were apparent resolved, and the case was dismissed about four months after filing.<\/p>\n In Cohen v. Wolkoff<\/a>, 13-CV-05612 (FB) (E.D.N.Y) Wolkoff and four corporations owned a group of commercial buildings that\u00a0over the years were “decorated” by many self-proclaimed aerosol artists. \u00a0To control this problem, Cohen\u00a0approached Wolkoff and offered to become the\u00a0curator of any future works that would be permitted to be painted on the walls. \u00a0Although\u00a0the agreement\u2019s precise terms remain disputed, Wolkoff orally agreed to this\u00a0general bargain. \u00a0Under Cohen\u2019s guidance, the quality of the aerosol art vastly improved, and\u00a0the site became known as 5Pointz<\/a> and evolved into a mecca for high-end works by\u00a0internationally recognized aerosol artists: Defendants decided to raze the buildings that were the canvas for the 5Pointz project in order to build two new condominium towers.
